These Terms govern access to and use of the LoyaltyOS platform and website. By using the service you agree to them. For paid subscriptions, an order form or master services agreement may supplement or supersede these Terms.
You are responsible for your account, your users, and the security of credentials and API keys you issue. Notify us promptly of any unauthorised use.
Do not misuse the service: no unlawful content, no attempts to breach security or tenancy isolation, no excessive load outside your plan limits, and no use that infringes others' rights.
Paid plans are billed per the applicable pricing and order form. Free sandboxes are non-production, capped, and may expire or be deprovisioned per the published process.
You retain ownership of your data. Our processing of personal data on your behalf is governed by the DPA. Service commitments (availability, support) are as stated in your plan.
We retain all rights in the platform. Open-source components (e.g. the widget library) are licensed under their stated terms.
The service is provided "as is" except as expressly stated; liability is limited to the extent permitted by law and as set out in your order form/MSA.
Either party may terminate per the order form. On termination, the published offboarding and data-export process applies, followed by cryptographic erasure.
These Terms are governed by the laws of the State of [Delaware], United States, without regard to its conflict-of-laws rules, and the federal laws of the United States where applicable. The parties submit to the exclusive jurisdiction of the state and federal courts located in [Delaware], except that either party may seek injunctive relief in any court of competent jurisdiction. (Bracketed state to be confirmed with counsel based on your entity’s formation/operating state; an arbitration/class-action-waiver clause may be added on advice.)
We may update these Terms; material changes will be posted here with a new effective date, and where required we will notify customers. Continued use after changes take effect constitutes acceptance.
